HELP! Need advice asap

    We live in Louisiana. This yeart LA started a charter school and due to lack of funds, I enrolled three of my children. My husband got a job in WV in September, so he went there and the kids and I stayed behind. Meanwhile, we have had several deaths in the family, one of which was my 12 year old nephew, and one of my boys wasn't adjusting very well the month that all this happened. He is used to speeding through things he gets and slowing down on things he doesn't. . . normal for homeschool families I am sure. Well, of course this school didn't see it that way. So I withdrew (at least I thought I did - the school now says I didn't) two of my kids and left my high school freshman enrolled. Monday when my high school freshman tried to log in (he's lowest grade is a 90%), it sayed he was denied access. We are in WV right now - we come up to visit all the time because it is just to hard to not be together as a family. Today, I get an email that says they kicked all my kids out because we are living in WV???? What??? They said they talked to a neighbor who said we moved. . . well, yeah, my husband did. It probably doesn't help that our house in empty except for a table, a few bookshelves, and some blow up mattresses. Anyway, if you are still reading, thanks for listening. Any advice would be welcome. . . also, I wouldn't mind pulling him out, but we have ZERO funds for any curriculum and high school is so IMPORTANT. . . plus, I wanted him to have the transcript for this year. . . Help!
    TIA from a mom in LA / WV that doesn't know what to do.

    I would call them and offer to provide proof if you have it such as utility bills, mortgage/rent statement, etc.

    Thank you. That is a good idea. Of course it also won't help that I just had to get a WV driver's license because my husbands tags expired, so he went ahead and moved the cars to WV to save a whole of money, and to do so, I had to get a WV driver's license.

    Big red flag. In most states, you are not allowed to "investigate" unless you are a licensed investigator with the state. (I know I am one.) I would start by asking a lot of questions. What neighbors did you talk to? Who was investigating me? Why was I being investigated? You can't get in trouble for asking questions. And as "government" employees they have to answer. Always ask: "where is that written?" Remember any question, even verbal questions fall under the FOI Act (Freedom of Information), though it helps to put them in writing. It sounds like the school has broken several rule or laws depending on your state.

    I would start with the questions. Talk to the Attorney General in your area (again questions based on the answers you get from the school) with general 3rd party questions, like Is it legal for a school administrator to do X. Involving outside agencies puts everyone on their toes. My experience is that questions are usually enough to stop them in their tracks. If not the answers to the questions usually give you enough information so you can plan your next move. Remember "where is that written", because with the government if it isn't written it doesn't exist.

    Voter's registration is also a big one to prove residency.

    what is available in WV, and do you see yourselves moving there ? Just an option that I see when reading your post, it sounds to me as if you are moving bit by bit.. I do not know how close in miles you are to the different states but if they dropped you without you knowing I would assume it was because they were not logging in often?
    I mean if it was from Friday to Monday you would have noticed. So take that into account as you explain to the people in charge why they are not really living in WV but that you really are in the state of origin.
    And if you are planning to move maybe this is sign that you should just for it. Sell or rent out your home and live in WV while your dh is working there, do a month to month rental and really move with the option that if his job brings him back you can have y our home back.

    Did the charter attempt to discuss the matter with you? Were you available for contact? Have your children been showing daily attendance? Did you contact the charter and let them know the circumstances before all this took place? Was there miscommunication on both parts? I ask because it does appear that you moved even if you didn't actually move the whole family.
    I do not believe we owe the state an explanation. However, as long as your children are enrolled in a government program, it is the governments playing field. Their game, their rules!
    Even if they investigated unlawfully, you will have a difficult time proving anything if you were not in complete compliance with the charter requirements. I would make sure that you did everything correctly, or that your children were in compliance with the charters requirements and then take it from there.

    I also agree about showing utility bills and a voter's registration. I know people who hold two active licenses from different states. As long as you can show proof of residence, and you did everything according to the charters rules, then hopefully you will not have a problem getting reenrolled. Personally, I wouldn't want to go back to the charter but I can understand your curriculum situation.

    Yes, my son was logging in, doing his work, and talking to teachers when he had a question. I guess they were investigating because they said they never got the withdrawal letter of my other two children and were counting them as truant. . . I think that is an excuse. We are moving there, after the house sells. It is just a very frustrating situation and I don't blame my son for wanting to start his freshman year over. Any good recommendations for high school curriculum that is cheap.
    Thanks to all who have taken the time to reply and listening to me vent.

    I am not sure which program you chose k12 or Connections Academy, but Connections is very strict about not being out of your address for more than 2 weeks in Louisiana. If you are going to be schooling from elsewhere for more than 2 weeks, you have to get written permission from the principal of the virtual school. K12 is less strict, but you have to have a residence in the state as your main residence. The 2 week thing is why we decided not to do it. I did not want to be seeking permission from a principal every time I want to go visit my Mom in a different state.
    Does WV have a virtual school with k12 or connections academy that your son's work can be transferred to if you want to continue the charter? I would probably do that first. I would also request a transfer of records from the charter school. I would want to see what was in my kid's records. In Louisiana, if they were reporting you truant you probably need to find out if you were reported to the district attorney's office. You could have warrants out and not know it. The truancy laws can get rough here. Have you had your mail forwarded? Did you receive any letters from the district attorney about the truancy? I would really be careful and make sure you are not being sought for allowing your children to be truant within the court system.
