    Ok-so I haven't actually had any trouble with CPS in our state (or any other for that matter), but I was told recently by our Legal group that CPS in our state is now being told that if the child is "homeschooled" then that is an indacator for abuse. Just wondering if anyone else has had these issues arise. There have been cases where children have been removed because of being homeschooled (at least that was what I've been told).

    I was reading on HSLDAs Site a while back that some states try to give HSers more trouble than others, they even have an article somewhere on the site about how to deal with CPS if they come because of Homeschooling. If you are in a state like that, I'd say being a member of HSLDA is a necessity.

    I have read about this on HSLDA but CPS cannot legally remove the child from the home unless the parent is not homeschooling legally. They may threaten but I do not think they have been able to remove a child unless they have grounds to do so.

    Whoa that is scary. I have always been concerned about this. I haven't heard anything like this in ohio. But then again, that isn't saying much. I will look into it. Thanks for bringing it up! If you hear anymore please let us know.

    That just sounds like rubbish! Whoever is telling you this is either very mixed up in their facts or just plain not telling you all the facts. How absurd and totally unrealistic, if you ask me.

    I'm under the impression that it happens a lot. Ignorance plays a part. People who don't understand what we are doing look for reasons to report homeschoolers. My dh's boss made has made the comment that we are neglecting our children by homeschooling, so I see how easily those rumors can get started.

    lovinhomeschool,these things do happen. You can read about the cases at www.hslda.org. There was one horrible case where a CPS worker came out a families home and when the father refused to allow them in his home the social worker came back with two police officers. They held the father until the social worker strip searched the child. The social worker had no warrent or probable cause. It isn't enough for a person to make a claim, there has to be physical proof. The social worker and police officer were both found guilty of going against the fathers 4th amendment rights and illigal entering and for searching the child. They had to pay 150,000 dollars in compensation to the father.
    It does happen because their are some people who do not know the laws of the state. It ends up the claims against this family were rubbish. If you read the case archives at HSLDA you will see that most cases are brought on by people ignorant to homeschooling or angry family members. Also many social workers are infact taught that the reason parents homeschool is because the children are being abused and neglected. This is why they usually go to the peoples homes and request to search the cupboards and refrigerator to make sure the house has ample food, they also have requested to interview each child individually.
    This is why I really do love HSLDA, as I have said in previous posts, they may not be needed in my years of homeschooling but when they are by others, they prove invaluable. They really let parents know their rights.
