My van was stolen!

    Thank you for the prayers.
    I feel them, when I tune out the world and concentrate on my babies. They are the reason for everything and no insurance fiasco or bankruptcy, or theft can take my eyes off the prize.

    There is no way your insurance co. can get away with not covering ALL of the damage from this incident. You should call the corporate headquarters. That is absurd!!

    The deductible is per incident, not for each type of damage. They also have to cover the adjusted value of the things in your van (up to your $ limit). I think the standard for totaling a vehicle is if the damage is more than 1/3 the value of the car. (Don't quote me on that.)

    Can you call a lawyer to get some advice about the situation? My mom had to call a lawyer last year to get advice on a lemon law claim (on a NEW car), and as soon as she mentioned, "my lawyer said" the dealership got busy fixing her car. Maybe that's what it'll take for you.

    I do think that I'd let your dh handle it. I think that people handle things differently with men than they do women.

    Jen just a note as I read more of this hehe, lots to read!
    Don't give up hope, things will work out, Iknow Insurance cos can be bad especially teh one you mentioned, I have been in many accidents not my fault ones and have dealt with many of the name brand co.s Unfortunately.
    Only one that tried to scam me was your company btw.
    So, with that know that your hubby will have to get pushy to get what you know you deserve, do not take what they want to give you at this point, they will make you think its all you deserve, but you dont! You are correct in believeing you paid for them to deal with this, if you are full coverage, they need to pay full fix it! That means you get the thing fixed, the whole thing, you pay your deductable and they pay the rest,
    YOu need to have it examiend by more than one person thugh and submit it to them the ones you have because just one what do you call the paper that they write up, estimate is not acceptable for courts either, they want more than one, so show you have more than one if you go to court over it.
    I knwo I am just one more person giving advice but I know they will do what they can to not pay out, and face it you paid for this money you deserve it!

    The only time we've had to file a claim, we got our own estimates, too. We got 3 and showed them to the adjuster (make copies!!). He couldn't get by with saying things didn't need to be fixed when 3 body shops said they did.

    Don't give up, Jen! Maybe you should contact the Better Business Bureau, too!

    Do not give up. FInd out if this claims adjuster works for your company or is an independent. Some companies use independent adjusters and they make money by settling for as little as possible. It is a sleazy deal. In the case below, My agent went to bat for me and got a nother adjuster involved. If you have a local agent, and have not done so, get to their office and let them know that you are offended that they have recieved the benifit of your premiums going through their office and they are not stepping up to the plate for you. There are folks above them they can turn to for a second consideration of your claim.

    I had a similar experience many years ago. I had a vehicle catch on fire. It took forever to get the insurance check, and it was very lowballed. When the vehicle had been fixed mechanically, It was outside waiting for my to pick it up. I had a transportation dilema and did not pick the vehicle up until a couple hours later than I expected. Some idiots came by and stole the seats out of my car. They started to tear the new carpets out but I had glued them down well. They had plenty of time and put all of the stuff back in the car that was in the seats etc.

    I made another claim, and the insurance adjuster attempted to put the claims together into a single claim and total my car. I had already fixed the motor, wiring etc, so this was a no go.

    It turned out that 71 super beetle seats are very rare, and the shop let me borrow a seat out of one of theirs so I woud at least have a drivers seat. LOL It took months to replace those seats, and I never did get them recovered nice like the once that were stolen.

    Jen, that is true they have to give you what the car is worth. Check with the headquarters. I think you got a fly by night man. That is working for money not really for the company. Let us know what happens.

    Yes, cleaned it out. Sorry.
    Yes, the van was fully insured, as it has a lien on it, because I am making payments on it.

    I am taking this back from my husband, You're right. If I am going to get nothing, then I have nothing to loose by being the crazy lady on the phone and in person, eh?

    My SIL had her van bronken into the other day....she had stopped in at a friends house for something and left her purse in the van. They broke the window grabbed her purse and ran. She had a $600 camera, $100 in cash and a Vera Bradley bag taken. She has to file it on her homeowners because her auto ins. won't cover it. Do you think that is what you will need to do with the bikes and such that were in your van? I guess depending on what they are worth and what your deductible is would matter if it is worth doing it or not. Or maybe that stuff is taken care of under your auto policy???

    So sorry you have to deal with all of this!! It just isn't fair.....

    My renters insurance is through the same company.....
    The bikes and hopper balls together were worth about $150 all together. And I am investigating wheather the contents were covered under the renters, but I doubt it. (It's like fighting for them to cover a $1 tshirt. ie: It may not really be worth it.)

    But if I am arguing to them that the motor is the most important, it makes my case weaker to also be claiming some bike (Of which I have noreceipts and no serial numbers for...)

    SO... i dunno.....

    I'd probably let the bikes go to get the van fixed and fixed RIGHT!! NOT rigged up to make it work for a while! You keep fighting!

    How do I get a lawyer to help me fight this, when I have no money at all? I already pay $200 a month to my bankruptcy lawyer...

    Yea, you need MONEY to go bankrupt!

    Jen, we had to file baknruptcy a few years ago. We did not need a lawyer, but the laws have changed since then. It was very quick. I'm sorry you have that added burden.


    On a different note: my next door neighbor just had his ford truck repo'd the kids thought it was "neat' watching it go up on one of those car wracks......... but I explained why and they were sad for him too. He had a stroke last year and I figure he just couldn't drive it or make payments since he wasn't working.

    jen, thats a good question My sister has been going through similar questions and re bankruptsy area there,
    You can however get free advice for lawyers many of them will give you one time advice, she has called a few and gotten advice from each one once as well as checked thier fees so she could decide what to do next.
    Try that, and see what you come up with, many will let you pay later after you get $ and will even add that into the amount you would receive in order to get thier fee. You can get some to agree to not get paid unless you win too, so check around sis, they are out there.
    I will pray theLord leads you to the right one though, cause some are scammers too!

    Amy that is sad, my sis has a car in her garage that they repoed, but never took, she called the bank the bank said call the car place, she called the car place they said the bank, after a year of back and forth the two parties said keep it, the car is a lemon with a capital L , and no one wants it, she cant get an engine for it but the res of its in great shape lol. Tarus, dont ever buy one!

    Today's drama!

    Hubby just called with more bad news!
    Isn't life delicious!
    (Yes, I am being sarcastic)

    Seems that when the van was first stolen, we did what we were supposed to do and ran to the bank to alter our accounts. Once agaoin, doign the right thing and we keep getting slpped...

    Turns out that since we had all of our checking accounts and bank cards, and since we were protected with fraud protector that we simply needed to put a "Password" on our account, so that no one could make changes to the account.... we did so....

    However, DH's work mate already got the ball rolling to cancel direct deposit... Yea.... the check was not in the bank last night, when I went to the grocery store...

    Sigh . . . . .
    So a check bounced, but the bank covered it.
    Now I have to try to talk them out of the $25 charge, because after our bills are paid, I have $59 to last two weeks. (That factors $100 a week for groceries)



    I give up....
    What next?
